Terms & Conditions

These Terms & Conditions apply to all quotations, agreements and deliveries of Jos Menting Grootkeuken Techniek, trading under the name JMGT Grootkeukentechniek, established at Nijverheidsweg 5, 7255 RA Hengelo (Gld), Netherlands, registered with the Chamber of Commerce (KvK) under number 89833147, VAT number NL865126434B01.

Article 1: Definitions

• JMGT: Jos Menting Grootkeuken Techniek (trading name JMGT Grootkeukentechniek), the contractor.
• Client: the party that places an order or assignment with JMGT.
• Agreement: any arrangement between JMGT and the client for the supply of products or services.

Article 2: Quotations and offers

All quotations issued by JMGT are without obligation and valid for 30 days, unless stated otherwise. JMGT is only bound by a quotation once the client's acceptance has been confirmed in writing.

Prices in quotations are exclusive of VAT, unless expressly stated otherwise. Price changes by suppliers or currency fluctuations are reserved.

Article 3: Delivery

Stated delivery times are indicative. Exceeding a delivery time does not entitle the client to compensation or to dissolution of the agreement, unless there is a demonstrable attributable failure to perform.

Delivery takes place at the address specified by the client. The risk in the delivered products passes to the client at the moment of delivery.

Article 4: Installation and assembly

Where installation or assembly has been agreed, the client must ensure a suitable and safe working environment, including the necessary utilities (water, electricity, gas) in accordance with the technical specifications of the equipment to be installed.

Article 5: Payment

Payment must be made within 14 days of the invoice date, unless otherwise agreed in writing. If the payment term is exceeded, the client is in default by operation of law and statutory commercial interest is due.

JMGT reserves the right to require an advance payment for orders.

Article 6: Warranty

New products are covered by the manufacturer's warranty as stated by the manufacturer. For used equipment (occasions), JMGT provides a warranty as described in the relevant quotation or product description.

The warranty lapses in the event of improper use, unauthorised repairs by third parties, or use that deviates from the intended purpose of the product.

Article 7: Liability

JMGT's liability is limited to the amount paid out by its insurance in the relevant case, or otherwise to the invoice value of the products or services supplied.

JMGT is not liable for indirect damage, consequential loss, loss of profit or loss caused by business interruption.

Article 8: Retention of title

All products delivered remain the property of JMGT until the client has fully met its payment obligations.

Article 9: Governing law and disputes

All agreements with JMGT are governed by Dutch law. Disputes will, in the first instance, be submitted to the competent court in the Gelderland district.
